If I understand the question correctly, the answer is no. However, if he has scholars they will become yours, and you will have to achieve the required number of scholarships needed for the scholars you won.

You won't get the scholars if you kill them when attacking though

No. You will not get the scholarships. However, if the dude was dumb enough to send a scholar as support to another city, you can recall the scholar back for your own use. However, you need to get the scholarships for that scholar.
